Today, the use of <strong>CBD in dietary supplements<\/strong>, cosmetics and food products is a global trend. Research confirms its calming, anti-inflammatory and neuroprotective properties, creating huge consumer demand.  <\/p>\n\n<p>However, <strong>the regulation of CBD in Ukraine<\/strong> remains a complex issue. Legal uncertainty in the field of food supplements is causing legitimate concerns among both manufacturers and consumers. Let\u2019s take a closer look at the risks involved and how to legally bring such a product to market.  <\/p>\n\n<h2 class=\"wp-block-heading\">What has changed in the legislation on cannabidiol?<\/h2>\n\n<p>On 16 August 2024, the long-awaited Law of Ukraine No. <a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/3528-20#Text\">3528-IX<\/a>, which regulates the use of cannabis plants for medical purposes, came into force. This legislation establishes a framework for the use of cannabinoids in medicinal products under strict control. <\/p>\n\n<p>However, for manufacturers of <strong>CBD supplements<\/strong>, the situation remains unclear:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the new law focuses exclusively on medical cannabis and medicines;<\/li>\n\n\n\n<li>the use of CBD in food products and dietary supplements (DS) has not yet been regulated by specific subordinate legislation;<\/li>\n\n\n\n<li>There are no clear government requirements regarding permissible CBD levels, the procedure for placing products on the market, or labelling.<\/li>\n<\/ul>\n\n<p>As a result, the market for food products containing cannabidiol has effectively ended up in a legal grey area.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>The main challenges facing CBD product manufacturers<\/strong><\/h2>\n\n<p>Companies planning to manufacture or import CBD supplements face four main barriers.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>1. Product classification<\/strong><\/h3>\n\n<p>Hemp extract can be classified in various ways:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>as a common food ingredient;<\/li>\n\n\n\n<li>as a novel food;<\/li>\n\n\n\n<li>as an active pharmaceutical ingredient.<br\/>An error in classification carries serious risks: ranging from heavy fines to the complete withdrawal of products from the market.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>2. Import of raw materials and customs control<\/strong><\/h3>\n\n<p>The importation of hemp extracts is strictly regulated. Businesses must comply with the provisions of the Law of Ukraine \u2018On Narcotic Drugs&#8230;\u2019, undergo specific customs checks and must have laboratory confirmation that the THC content does not exceed the limits permitted by law. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>3. Signage and advertising<\/strong><\/h3>\n\n<p>The labelling of dietary supplements requires particular care. Any claims regarding the product\u2019s therapeutic properties automatically classify it as a medicinal product in the eyes of the law. The use of medical claims is strictly prohibited for dietary supplements.  <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>4. Safety and evidence base<\/strong><\/h3>\n\n<p>The manufacturer is required to provide documentary evidence of the product\u2019s safety. This includes verifying the stability of the formulation, the purity of the extract, the absence of psychoactive impurities, and conducting a toxicological assessment. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Our experience: how to safely bring CBD supplements to market<\/strong><\/h2>\n\n<p>We have a track record of successfully supporting CBD product manufacturers. However, its full development depends on the adoption of relevant secondary legislation, the official recognition of CBD\u2019s status as a food ingredient, and the establishment of transparent regulatory frameworks. <\/p>\n\n<p>Whilst these regulations are being drafted, manufacturers should proceed with the utmost caution: they should carry out a professional legal analysis and risk assessment, and strictly comply with the technical regulations currently in force.<\/p>\n\n<p>Today, CBD is more than just a passing fad. It is a prime example of an industry where innovation is far outpacing regulation.
